Terms of Service
Last updated: September 17, 2026
These Terms of Service ("Terms") form an agreement between you, and the company you represent ("you," "your," or "Customer"), and Tanstone Technologies LLC, a Utah limited liability company ("Tanstone Technologies," "we," "us," or "our"), governing your access to and use of AdvantaBuild, our web-based project management application for specialty subcontractors, together with any related features, content, and services (collectively, the "Service"). By creating an account, clicking "I agree," or otherwise accessing or using the Service, you accept these Terms on behalf of yourself and, if applicable, the company or organization you represent. If you do not agree, do not use the Service.
1. The Service
AdvantaBuild provides tools for specialty subcontractors to manage projects, including daily logs, RFIs, submittals, punch lists, budgets, change orders, contracts, vendor bills, progress billing, scheduling, and drawing markup. We may add, change, or remove features at any time, and may offer optional integrations with third-party services (such as QuickBooks Online) and optional paid add-ons, each subject to the terms in this document and any additional terms presented at the time you enable them.
2. Accounts and eligibility
You must provide accurate registration information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use. The person who registers a company account is responsible for managing that company's users, roles, and permissions within the Service.
You represent that you are at least 18 years old and have the authority to bind the company or organization you register on behalf of to these Terms.
3. Subscriptions, trials, and payment
New accounts begin with a free trial period disclosed at signup. No payment method is required to start a trial. If you choose to subscribe to a paid plan, you authorize us (through our payment processor, Stripe) to charge the payment method you provide on a recurring basis (monthly, unless otherwise agreed) until you cancel.
Plans include a limited number of office-role seats and, on some plans, a limited number of active projects, as described on our pricing page at the time of purchase. We may enforce these limits by declining to create additional seats or projects beyond your plan's allowance until you upgrade.
You may cancel your subscription at any time from within the Service; cancellation takes effect at the end of the current billing period, and you retain access until then. Except where required by law, fees are non-refundable. We may change our prices prospectively with notice; continued use after a price change takes effect constitutes acceptance of the new price.
We do not store your full payment card details — those are collected and processed directly by Stripe, Inc., subject to Stripe's own terms.
4. Your data and content
"Customer Data" means the data, documents, photos, and other content you or your users submit to the Service (project records, daily logs, drawings, budgets, contracts, employee and crew information, and similar materials). As between you and us, you retain all ownership rights in Customer Data. You grant us a limited license to host, copy, transmit, and display Customer Data solely as necessary to provide and support the Service to you.
You are solely responsible for the accuracy, legality, and appropriateness of Customer Data, and for having the necessary rights and consents (including from your employees and crew) to submit it to the Service.
5. Third-party integrations
The Service offers optional, user-initiated integrations with third-party platforms, including QuickBooks Online (Intuit Inc.) and Stripe. If you connect a third-party account, you authorize us to access and exchange data with that account as described in our Privacy Policy and as necessary to provide the integration's functionality. Our QuickBooks Online integration is pull-only: it imports the records you select and never writes data back to your QuickBooks company. You may disconnect any integration at any time from Settings.
Your use of a connected third-party service is also governed by that provider's own terms and privacy policy, which we do not control. We are not responsible for the acts, omissions, availability, or accuracy of third-party services.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Upload content that infringes another party's intellectual property or privacy rights;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except where applicable law expressly permits it;
- Resell or provide the Service to third parties as a standalone service without our written consent; or
- Use automated means to scrape or extract data from the Service beyond normal use.
7. Intellectual property
The Service, including its software, design, and branding (excluding Customer Data), is owned by Tanstone Technologies LLC and its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL NEVER BE LOST. THE SERVICE IS A PROJECT-MANAGEMENT AND RECORD-KEEPING TOOL AND IS NOT A SUBSTITUTE FOR YOUR OWN PROFESSIONAL, LEGAL, ACCOUNTING, OR CONTRACTUAL JUDGMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANSTONE TECHNOLOGIES LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Tanstone Technologies LLC from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your Customer Data, your breach of these Terms, or your violation of any law or third-party right.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service, in which case we will provide reasonable notice where practicable. Upon termination, your right to use the Service ends; provisions of these Terms that by their nature should survive (including Sections 4, 7, 8, 9, 10, and 13) will survive.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by email or an in-app notice, before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Utah, and you consent to the personal jurisdiction of those courts.
14. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
